MALITA LASER S.L., owner of the website (hereinafter the CONTROLLER), provides users with this document to comply with the obligations of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), and to inform users about the conditions of use.

Anyone accessing this website takes on the role of user and undertakes to strictly observe and comply with the provisions set out here, as well as any other applicable legal provision.

2. Purpose

Through the website we offer users access to information about our aesthetics services and treatments, and enable contact and appointment requests.

3. Privacy and data processing

Where access to certain content or services requires personal data, users guarantee its truthfulness, accuracy, authenticity and validity. The company will process such data automatically according to its nature or purpose, as set out in this Privacy Policy.

4. Industrial and intellectual property

All website content — in particular designs, texts, images, logos, icons, buttons, software, trade names and trademarks — is subject to intellectual and industrial property rights, the exclusive property of the company and/or third parties. The user undertakes not to reproduce, copy, distribute, make available, transform or modify such content without express authorisation.

Access to the website does not imply waiver, transfer, licence or assignment of these rights. Removing, circumventing or manipulating the copyright and technical protection devices is prohibited.

5. User obligations and responsibilities

The user undertakes to make appropriate and lawful use of the website and its content in accordance with applicable law, these conditions, generally accepted morality and public order; to obtain the necessary technical means; and to provide truthful, up-to-date information in the forms.

The user must refrain from: unauthorised or fraudulent use of the site; accessing restricted areas without meeting the conditions; causing damage to physical or logical systems; introducing or spreading viruses; manipulating data of the company, providers or other users; reproducing, distributing or publicly communicating content without authorisation; and removing or hiding notices of property rights.

In particular, the user undertakes not to transmit content contrary to fundamental rights, that induces unlawful, discriminatory, violent or offensive conduct, that attacks honour or privacy, that constitutes unauthorised advertising or that contains viruses. If a password is provided, the user must use it diligently and confidentially.

6. Liability

Continuous access and the correct display, download or usefulness of the site's elements are not guaranteed when impeded by factors beyond our control. We are not responsible for decisions taken as a result of accessing the content.

We may interrupt the service or terminate the relationship with the user if we detect use contrary to these conditions. We are not liable for damage arising from interference, interruptions, failures or telecommunications faults beyond our control, from unlawful intrusions via malicious software, from misuse of the website, or from security errors due to browser malfunction.

The user shall hold the company harmless against any damages arising from third-party claims as a result of their access to or use of the website, including the use of robots, spiders or similar tools.

6.1. Bookings, packages and cancellations — Impuls Centre

Based on the Civil Code, the General Law for the Protection of Consumers and Users and applicable healthcare regulations, the following terms governing appointment bookings, packages and cancellations are provided.

Packages: each package includes a specific number of sessions and a validity period. Sessions not used within the period are not refunded or transferred to another period. Failure to attend a confirmed appointment without prior cancellation of at least 24 hours means automatic loss of the session (Art. 1101 of the Civil Code).

Consultation with diagnosis — €50: to attend the consultation you must book a time and pay a €15 prepayment, which is fully deducted from the cost of the consultation (€50). If the patient does not attend or cancels less than 24 hours in advance, the prepayment is not refunded, as it is considered a reserved service and a blocked time slot.

Cancellations and changes: must be made more than 24 hours in advance. Appointments cancelled outside this period, or no-shows, will be considered services rendered for contractual purposes.

Using the services, purchasing packages or requesting a consultation implies full acceptance of these conditions.

7. Hyperlinks

The website may include links to other websites managed by third parties, to facilitate access to information from partner companies. The company is not responsible for the content of such sites or the services they offer.

The user is granted a limited, revocable and non-exclusive right to create links to the website's home page for private, non-commercial use. Links may not misrepresent the relationship with the company or include unlawful or offensive content. The company may request the removal of any link at any time.

8. Data protection (GDPR)

To use some services, the user must provide personal data (name, phone, email and form message). The company processes this data automatically and applies the corresponding security measures, in compliance with the GDPR (EU) 2016/679, LOPDGDD 3/2018 and LSSI-CE 34/2002.

Purpose: to handle the request, manage the appointment and provide the services. Legal basis: the user's consent and performance of the service relationship. Retention: for the duration of the relationship and the legally required periods. Recipients: data is not shared with third parties except by legal obligation; technology providers are used as processors with appropriate safeguards.

The user may exercise the rights of access, rectification, erasure, objection, restriction and portability by writing to impuls.espana@gmail.com. They may also file a complaint with the Spanish Data Protection Agency (www.aepd.es).

9. Cookies

The company reserves the right to use cookie technology on the website to recognise the frequent user and personalise their use (language, content). Cookies collect the user's IP address, with Google being the controller of this analytics information.

Cookies are files sent to the browser to record navigation. The user can configure their browser to be warned of cookies and to prevent their installation. Further information is available in the Cookie Policy.

10. Statements and warranties

The content and services offered on the website are purely informative. No warranty or statement is given as to their lawfulness, reliability, usefulness, truthfulness or accuracy, except where such statements cannot be excluded by law.

11. Force majeure

The company will not be liable for the impossibility of providing service due to prolonged interruptions of the electricity supply, telecommunications lines, social conflicts, strikes, floods, acts and omissions of the Government and, in general, any event of force majeure or unforeseeable circumstances.

12. Dispute resolution. Applicable law and jurisdiction

These conditions and the use of the website are governed by Spanish law. For the resolution of any dispute, the parties shall submit to the Courts of the Controller's registered address.

If any provision is found unenforceable or void, such invalidity shall not affect the remaining conditions, which shall remain valid and enforceable.
